Privacy Policy of Skilled – Recruitment Solutions GmbH

Principle

We, Skilled – Recruitment Solutions GmbH, are committed to the correct and transparent handling of personal data and the protection and security of personal data of our clients and candidates as well as visitors to our website (hereinafter “users”). This privacy policy provides you with an overview of how we handle personal data and what rights you have as a user.

Legal basis and scope

To ensure the protection of all users, we undertake to comply with these principles and the relevant data protection legislation, in particular the Swiss Federal Data Protection Act. In the event that personal data of persons residing in the European Union is processed, the General Data Protection Regulation of the European Parliament and of the Council (“GDPR”) may apply.

We do not process personal data without a legal basis. The following serve as a legal basis 

  • the consent,
  • the fulfilment of a contract or pre-contractual measures,
  • legal obligations or the protection of the vital interests of the data subject or another natural person,
  • the protection of a legitimate interest on our part (e.g. economic interests) or on the part of a third party.

These data protection regulations do not apply to websites of third parties which can be accessed via our website. No liability is accepted for these websites and no guarantee is given that these data protection regulations will be complied with.

Definitions and terms 

The term “personal data” means any information relating to an identified or identifiable individual, i.e. any information, regardless of its origin, form or presentation, that can be personally attributed to an individual. The term “personal data” is equivalent to the term “individual data”.

“Processing” or “handling” means any use of your data, including but not limited to the collection, storage, management, use, transmission, disclosure or deletion of personal data.

Purpose of the processing of personal data – Website

 In principle, we do not process any personal data of the user when visiting our website. However, general technical visit information is automatically logged when visiting our website. This includes the following information, which is collected anonymously:

  • IP address
  • Browser, operating system, language
  • Date, time and duration of visit
  • Visitor type (first-time visitor/return visitor)
  • Individual tags or variables
  • Referrer URL
  • Internet service provider and its location
  • Cookies (see below for more information)

Technical and administrative measures are taken to ensure that users cannot be identified at any time unless they have consented to the processing of personal data. Personal data that may relate to a specific, identifiable person is anonymised if at all possible.

Purpose of the information collected – Website

 The aforementioned information is collected and processed for the purpose of enabling the use of the websites, ensuring system security and stability, analysing the use of products, collecting general demographic information and optimising the products. 

In addition, the information is used for internal statistical purposes. The information is used in particular for product improvement, marketing measures and target group-specific advertising. The user is not identified in the process. 

Likewise, no connection is made between this automatically collected information and personal data stored by the provider. 

Newsletter 

The user has the option of subscribing to a newsletter. For this purpose, the user registers for the newsletter with his/her e-mail address. After registering, the user receives an e-mail with a link to confirm the registration. If the registration is not confirmed, the user will not receive the newsletter. 

The Skilled – Recruitment Solutions GmbH informs with the newsletter about own events, information on developments in human resources, news and information about our company and our services. 

Cookies 

(a) General 

So-called “cookies” are used on our website to manage advertising and to determine the popularity of individual subject areas. These are text files that are stored on the user’s system for the purpose of analysing the use of the products (usage behaviour, range measurement, product optimisation and delivery of advertising formats tailored to target groups). In this way, users do not have to re-register for each visit to services requiring registration and, in addition, individualised services and products can be offered to the user in this way. These text files do not contain any personal data. The use of cookies can be prevented by the corresponding browser settings. However, this may impair the functionality of the products under certain circumstances. Access to areas where registration is mandatory and the use of certain services is only possible with cookies switched on. The provider accepts no liability for the careless and/or unlawful use of data by third parties and recommends that you consult the data protection provisions of the relevant websites. For statistical purposes and to optimise the products, the provider may use the analysis services of Google Analytics or others. As a matter of principle, no personal data is collected for this purpose. Should this nevertheless be necessary, only as much data as is minimally required for the fulfilment of the order will be transmitted. You will find the relevant information on these services below.

(b) Google Analytics 

We use the functions of the Google Analytics web analysis service on our website. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics uses cookies that are stored on the user’s computer and enable an analysis of the user’s website usage. The information generated by the cookie is usually transferred to a Google server in the USA and stored there. The user can prevent the collection of the data generated by the cookie and related to their use of the website (including the IP address) to Google as well as the processing of this data by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de. If the user deletes cookies or uses a different browser, this will result in the opt-out cookies also being deleted or not being set. The opt-out must be reactivated when visiting our website again.

 

 Third party cooperation

As a matter of principle, personal data is not passed on to third parties.

Exceptions to this exist with the consent of the users, in the case of a legal obligation and in the context of a cooperation with a partner who supports us in the provision of our services.

The hosting provider of our website is Hostpoint. In addition, we make use of the services of Google by embedding a “Google Maps” map with our location on our website. Further information on the “Google Analytics” services used as well as the social media plugins used can be found under the corresponding titles of this privacy policy.

If we are supported in data processing by a partner, this partner is obliged to act in compliance with the relevant legal provisions, including the applicable data protection regulations, and in accordance with this data protection declaration. In doing so, partners may neither process this personal data for their own purposes nor pass it on to third parties. We reserve the right to process and disclose information and personal data to the relevant civil and law enforcement authorities in order to comply with applicable laws, regulations, legal proceedings or criminal investigations.

 

Plug-ins from social media services 

Plug-ins from third-party social media services such as Facebook, LinkedIn, Xing and others are integrated on our website. If the user has a user account with these third parties, it may also be possible for these third parties to measure and evaluate the use of the provider’s products. In the process, further personal data such as IP address, personal browser settings and other parameters may be transmitted to these third parties and stored there.

We have no control over the use of such personal data collected by third parties and therefore cannot accept any responsibility or liability for it. The user can unsubscribe from the newsletter list at any time by clicking on the “Unsubscribe” link at the end of the newsletter.

Purpose of the information collected Candidate profiles 

If you transmit data to Skilled – Recruitment Solutions GmbH via the homepage (incl. integrated services and tools from third parties such as the job centre), via email or via third-party providers (job portals, social media, LinkedIn, Xing etc.), this personal data is stored, changed and processed in encrypted form. Skilled – Recruitment Solutions GmbH needs to process certain information about candidates in order to provide its services professionally and in good faith. Skilled – Recruitment Solutions GmbH therefore requests certain information from candidates, which is used to offer the best possible jobs and projects. Among other things, names, ages, contact details and information about education and professional experience are required for this process. Also information such as whereabouts, financial and salary data, as well as information regarding social security. 

Below is a list of the information we collect from you in the course of our collaboration. This list is not exhaustive and we reserve the right to store, process and reuse ALL information that you provide to us in interviews, by post or in digital form.

– Name

– Date of birth and age

– sex

– Civil status

– Copies of various documents such as ID, passport, driving licence, social security cards, AHV

 – Identity cards, any documents necessary to comply with the Staff Hire Agreement and local laws.

– All information relevant in case of emergency

– Curriculum vitae with work history

– Education information

– Reference contacts

– Residence status

– Nationality/hometown

– Financial data such as debt collection register information if necessary

– Information on previous convictions if relevant

– Any information that you provide to us, either unsolicited or requested

– Information that is publicly available (e.g. LinkedIn) or has been provided to us by third parties (e.g. reference contacts)

User rights (information, revocation, deletion, return) 

The user is entitled to information free of charge at any time regarding his or her stored personal data. He/she has the right to revoke consent to the processing of his/her personal data at any time and also to restrict the processing of his/her personal data, whereby this may be accompanied by restrictions on the user’s rights of use.

Mandatory legal provisions on the storage of data remain reserved.

Furthermore, the user has the right to have his/her personal data handed over in a common, electronically readable format.

Skilled – Recruitment Solutions GmbH reserves the right to request proof of identity in connection with requests for information or deletion. 

A user’s personal data will be deleted within 30 days of receipt of a corresponding request for deletion. As a rule, data is deleted after the statutory retention periods have expired. If data is not affected by this, it is deleted when its agreed purpose no longer applies.

Final provisions 

This privacy statement may be changed at any time. The last line of this policy contains the date of the last update. If any provision of this privacy policy is invalid, this shall not affect the validity of the remaining provisions. Invalid provisions shall be replaced by provisions that come as close as possible to the intended meaning of the invalid provision.
